Terms of use and disclaimer

DRAFT for review before launch. Not yet reviewed by a lawyer. Effective date: [to be set at launch].

The short version: TotaledRight sells do-it-yourself informational reports. We are not a licensed appraiser, public adjuster, insurance agent or law firm. We don't give legal advice, we don't negotiate with or contact your insurer, and we can't guarantee any result. You decide what to do with the information and what to send.

1. Who we are

TotaledRight (totaledright.com) is operated by Aubrey Greene, a sole proprietor in Texas, doing business as TotaledRight ("we", "us"). By using the site, the free check or a paid report, you agree to these terms.

2. What the service is

The free check reads an insurer valuation report you provide and flags items that commonly deserve a closer look. The paid report adds comparable vehicle listings, mileage and equipment adjustments, an estimated market value range, a checklist and a letter template. All of this is general information to help you review your own claim.

3. What the service is not

4. Estimates and data

Values, ranges and gap estimates are estimates. They depend on the information you give us, the insurer report you upload, third-party data (such as NHTSA vPIC and listings data) and stated assumptions (such as default per-mile and option values). Listings can be stale, incomplete or wrong, and a listing's asking price is not necessarily the price a car sells for. Check every figure before relying on it. Sample reports use EXAMPLE data.

5. Your responsibilities

6. Payment and refunds

The full report costs the price shown at checkout (currently $49 plus any applicable sales tax), charged once through Stripe. If we can't generate a report for your vehicle, we'll refund you in full. You can re-run your report free within 7 days if you correct your details. [Confirm refund policy before launch.]

7. Intellectual property

You may use your report and letter for your own claim, including sharing them with your insurer, appraiser or attorney. You may not resell reports or scrape the service.

8. No warranty; limitation of liability

The service is provided "as is" without warranties of any kind. To the fullest extent the law allows, we are not liable for indirect or consequential losses, including any claim outcome, and our total liability for any claim relating to the service is limited to the amount you paid us for the report in question.

9. Governing law

These terms are governed by the laws of the State of Texas. [Venue and dispute terms to be confirmed with counsel.]

10. Changes and contact

We may update these terms; the effective date above will change. Questions: [email protected].
